In Bihar caste enumeration case, the Nitish government has again received a jolt from the Supreme Court on Thursday. The Supreme Court has upheld the decision of the Patna High Court while hearing a petition related to caste-based enumeration. Now the matter will be heard in the Supreme Court on July 14.
The court of Justice Abhay S. Oak and Justice Rajesh Bindal on Thursday heard a petition challenging the Patna High Court order regarding caste enumeration. The Supreme Court said, “It is a matter of investigation whether the census is being done under the garb of caste enumeration. The Patna High Court has given an interim stay considering caste enumeration as unconstitutional. In this case, it would be better to have a hearing in the Patna High Court first.
The court said that the hearing is to be held in the Patna High Court on July 3, 2023. If the High Court does not hear the matter for any reason, then on July 14, inform the Supreme Court about it. After this, the arguments of the Bihar government will be heard here.
Let us inform that the Patna High Court’s order of 4 May 2023 to ban the caste-based enumeration by the Nitish government has been challenged in the Supreme Court, which was to be heard on Wednesday, but Supreme Court Justice Sanjay Karol on Wednesday recused himself from hearing a petition related to caste-based enumeration in Bihar. Due to this, the petition could not be heard on Wednesday. Justice Karol was elevated as a Supreme Court judge on 6 February 2023.
